巴西交通法典(CTB)第162至255条规定了被视为交通违法行为的行为清单,即违反上述法典或补充立法中任何规定的行为。

对上述每种违法行为都规定了处罚和行政措施,包括:书面警告、CNH罚款、吊销CNH、吊销驾驶许可或强制参加进修课程。

关于罚款,更具体地说,CTB根据交通违法行为的严重程度确定罚款金额,轻微(88.38雷亚尔)、中等(130.16雷亚尔)、严重(195.23雷亚尔)和非常严重(293.47雷亚尔)。 CTB规定的交通违法行为之一是逆向行驶。

根据上述法律第186条第I项,在双向通行的道路上逆向行驶,除非是为了超越另一辆车,且仅在 必要时间内,尊重逆向行驶车辆的优先权,否则被视为严重违规行为,将处以CNH罚款。 因此,在此具体案例中,适用的罚款如下价值195.23雷亚尔。

同一条款的第二小节规定,在有单行交通标志的道路上逆向行驶是非常严重的违法行为,与前一种行为一样,将被处以罚款。

在这种情况下,罚款金额为293.47雷亚尔。

逆向行驶罚款:其他CTB违法行为

除了逆向行驶外,CTB还规定了其他逆向行驶的行为,这些行为也被视为违章行为,将被处以CNH罚款。 请参见以下内容:

CTB在其第181条第XV项中规定,将车辆停放在驾驶区内属于中度违规行为,罚款130.16雷亚尔。

在第182条第IX项中,CTB将对向停车的行为定性为中度违规,罚款130.16雷亚尔。

在道路错误一侧超车

在第203条中,CTB规定了在以下情况下从对面超车的行为:

  • 在没有足够能见度的弯道、斜坡和坡道上(I项);
  • 在人行横道上(第II项);
  • 在桥梁、高架桥或隧道上(第III项);
  • 在信号灯、大门、闸门、路口或任何其他妨碍自由通行的设施旁排队站立(第IV项);
  • 有双黄线或单黄线纵向道路标线分隔对向车流。

在所有这些情况下,对向超车被视为非常严重的违法行为,但罚款金额不是293,47兰特,而是该金额的5倍,即1,467,35兰特。

值得注意的是,如果在12个月内再次犯罪,对CNH的罚款将是规定罚款的两倍,即2934.70兰特。

执行返回操作

CTB第206条第IV项规定,在十字路口进行返回操作,进入十字路口的相反方向是非常严重的违法行为,罚款293.47雷亚尔。
